Overview
Welcome to Vibes. The terms "we", "us" and "our" refer to Vibes. We operate this store and website, including all related information, content, features, tools, products and services, to provide you, the customer, with a curated shopping experience (the "Services"). Vibes is powered by Shopify, which enables us to provide the Services to you.
By visiting, interacting with or using our Services, making a purchase, or otherwise providing information to us, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you should not use or access our Services. Nothing in these Terms limits any rights you have under the Australian Consumer Law that cannot be lawfully excluded.
These Terms apply to all users of the Services, including visitors, browsers, customers and contributors of content.
Section 1 — Eligibility, Access and Account
By using the Services, you confirm that you are at least 18 years of age, that you have read and understood these Terms, and that you have the authority to agree to them. If you do not meet the age requirement, you may not purchase through the Services.
To use the Services, you may be asked to provide certain information, such as your email address and billing, payment and shipping details. You confirm that all information you provide is true, accurate, current and complete, and that you have the right to provide it.
You are responsible for maintaining the security of your account credentials and for all activity on your account, whether or not authorised by you. You agree to notify us immediately of any unauthorised use. You may not transfer, sell, assign or license your account to anyone else. We may refuse, suspend or terminate an account at our discretion, including for any breach of these Terms.
Section 2 — Our Products
We have made every effort to represent our products accurately. However, colours and product appearance may differ from how they appear on your screen depending on your device and its settings. We do not warrant that the appearance or quality of products will be identical to how they are depicted online.
All product descriptions, formulations and availability are subject to change at any time at our discretion. We may discontinue any product, and we may limit the quantities we offer to any person, region or jurisdiction on a case-by-case basis.
Section 3 — Health Disclaimer and Not Medical Advice
Our products are dietary supplements intended to support general wellbeing. They are not intended to diagnose, treat, cure or prevent any disease or health condition.
The information on our Services is provided for general informational and educational purposes only and is not medical, health or professional advice, and is not a substitute for advice from a qualified healthcare professional. You should not rely on it to diagnose or treat any health problem, or in place of any treatment prescribed by your doctor.
Always read the label and use only as directed. Always seek the advice of your doctor or pharmacist before starting any supplement, and never disregard or delay seeking professional medical advice because of something you read on our Services. If you are pregnant, breastfeeding, taking medication, immunocompromised, or managing a health condition, consult your healthcare professional before use. If you experience any adverse reaction, stop use and seek medical advice. Always read the label and follow the directions for use.
Section 4 — Orders
When you place an order, you are making an offer to purchase. Vibes may accept or decline any order at its discretion, and your order is not accepted until we confirm it. We must receive and process your payment before an order is accepted. Please review your order carefully before submitting, as we may be unable to accommodate cancellations after an order is accepted. If we do not accept, change or cancel an order, we will try to notify you using the contact details you provided.
We may refuse or cancel any order where we suspect fraud, an unauthorised or unlawful transaction, a pricing or description error, or unavailability. Your purchases are subject to our Returns and Refund Policy. You confirm that your purchases are for your own personal or household use and not for commercial resale or export.
Section 5 — Prices and Billing
Prices, discounts and promotions are subject to change without notice. The price charged will be the price in effect when the order is placed, as set out in your order confirmation. Prices are in Australian dollars unless stated otherwise, and do not include shipping or handling unless stated.
You agree to provide current, complete and accurate purchase and payment information, and to keep it updated. You confirm that the payment information you provide is true, that you are authorised to use the payment method, and you agree to pay all charges incurred at the posted prices, including shipping and any applicable taxes. You authorise us to update your payment details with information your bank or card issuer may supply.
Section 6 — Subscriptions
If you purchase a subscription, you authorise us to charge your payment method on a recurring basis at the interval shown at checkout, until you cancel. You can skip, pause or cancel at any time from your account before your next billing date. Cancelling stops future orders but does not retroactively cancel an order that has already been billed and processed. We will give you advance notice of any change to your subscription price. Subscription orders are otherwise governed by these Terms and our Returns and Refund Policy.
Section 7 — Shipping and Delivery
All delivery times are estimates and are not guaranteed. We are not responsible for delays caused by carriers, customs or events outside our control. Once we hand products to the carrier, risk of loss passes to you, subject to your rights under the Australian Consumer Law.
Section 8 — Promotions
From time to time we may run promotions, discounts, giveaways or offer promotional codes, which may be governed by their own terms. Where those terms conflict with these Terms, the promotion terms govern for that promotion. Unless stated otherwise, promotional offers are single use, non-transferable, have no cash value, cannot be combined with other offers, may expire, and may be modified, suspended or withdrawn by us at any time.
Section 9 — Intellectual Property
Our Services, including all trademarks, brands, text, displays, images, graphics, reviews, video, audio and software, and their design, selection and arrangement, are owned by Vibes, its affiliates or licensors, and are protected by Australian and foreign intellectual property laws.
These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, transmit or commercially exploit any material from the Services without our prior written consent. Nothing in these Terms grants you any licence or rights under any intellectual property of Vibes, Shopify or any third party except as expressly stated. All rights not expressly granted are reserved.
Vibes' names, logos, product and service names, designs and slogans are trademarks of Vibes or its licensors, and you must not use them without our prior written permission. Shopify's trademarks belong to Shopify. All other trademarks belong to their respective owners.
You also must not use our Services or content in connection with training, developing or operating any artificial intelligence, machine learning or large language model, or use any automated means to scrape, crawl or copy any part of the Services, except that public search engines may index the Services for the purpose of creating publicly available search results.
Section 10 — Reviews and User Content
The Services may let you submit reviews, ratings, comments, photos, feedback or other content ("User Content"). You are solely responsible for your User Content and any opinions or claims in it. Reviews reflect the views of their authors and are not endorsed by Vibes.
When you submit User Content, you grant us a perpetual, worldwide, non-exclusive, royalty-free, sublicensable and transferable licence to use, reproduce, modify, adapt, publish, translate, distribute and display it in any medium for any purpose, including marketing and promotion, together with any name or handle you submit with it. To the extent permitted by law, you waive any moral rights in your User Content.
You confirm that you own or have the rights to your User Content, that any review is based on your genuine first-hand experience, that you have disclosed any payment or incentive you received in connection with it, and that it does not infringe any third-party right or contain unlawful, defamatory, misleading or malicious material. You must not submit reviews in exchange for payment without disclosing it, impersonate anyone, or include another person's private information.
We have no obligation to monitor User Content, but we may remove or edit any User Content at our discretion, including content we consider unlawful, misleading, offensive or in breach of these Terms. Nothing here prevents you from leaving an honest review.
Section 11 — Marketing and SMS Communications
If you opt in, you agree to receive recurring marketing communications from us by email or text message (SMS), which may include offers, product updates, order and cart reminders, and requests for reviews. Consent to marketing messages is not a condition of purchase. Message frequency varies, and standard message and data rates from your carrier may apply.
You can opt out of email marketing using the unsubscribe link in any marketing email, or opt out of SMS by replying STOP to any message. Even if you opt out of marketing, we will still send you transactional messages such as order confirmations and account or delivery notifications. You agree to keep your contact details accurate and to notify us if your mobile number changes. Carriers are not liable for delayed or undelivered messages.
Section 12 — Privacy
All personal information we collect through the Services is subject to our Privacy Policy. Because the Services are hosted by Shopify, Shopify also collects and processes information about your use of the Services to provide and improve them, and your information may be transmitted to and shared with Shopify and third parties that may be located outside Australia. Please review our Privacy Policy for details.
Section 13 — Relationship With Shopify
Vibes is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Vibes. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sale between you and Vibes, including any injury, damage or loss resulting from purchased products and services. You expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with Vibes.
Section 14 — Third-Party Links and Tools
The Services may contain links to, or tools provided by, third parties that we do not control or endorse. We provide access to these "as is" and "as available" without warranties, and we are not responsible for the content, accuracy or practices of any third-party site or tool, or liable for any loss arising from your use of them. Your dealings with third parties are solely between you and them, and you should review their terms and policies before transacting.
Section 15 — Prohibited Uses
You may use the Services for lawful purposes only. You must not use the Services for any unlawful, fraudulent or malicious purpose, to breach any laws or regulations, to infringe anyone's intellectual property, to harass, abuse, defame or harm any person, to discriminate against any person or group, to transmit false or misleading information, to send spam or unsolicited promotional material, to impersonate any person or entity, or to interfere with anyone's use of the Services.
You also must not upload malicious code, reproduce or resell any part of the Services, collect others' personal information, scrape or crawl the Services, circumvent its security features, or attempt to gain unauthorised access to the Services or related systems. We may suspend, disable or terminate your access at any time if we determine you have breached these Terms, and may refer serious violations to law enforcement.
Section 16 — Accuracy of Information
Occasionally there may be typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges or availability. We reserve the right to correct these and to change or update information, or cancel orders, if any information is inaccurate at any time without prior notice, including after you have submitted an order. We are not obliged to update information on the Services, and you should not rely on it as your sole source.
Section 17 — Disclaimer of Warranties
The information presented through the Services is provided for general information purposes only, and we do not warrant its accuracy, completeness or usefulness. Any reliance you place on it is at your own risk
To the fullest extent permitted by law, and except as expressly stated by us or required by the Australian Consumer Law, the Services and all products are provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Services will be uninterrupted, secure or error-free.
Nothing in this section excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law that cannot be lawfully excluded ("Non-Excludable Guarantees").
Section 18 — Limitation of Liability
Certain rights and remedies, including liability for death or personal injury caused by negligence, for fraud, and the consumer guarantees under the Australian Consumer Law, cannot be excluded or limited by law. Nothing in these Terms excludes, restricts or modifies any such right, remedy or liability, and the limitations in this section apply only to the extent the law permits.
To the fullest extent permitted by law, and subject to the paragraph above, Vibes and its partners, directors, officers, employees, affiliates, agents, contractors, licensors and service providers, and those of Shopify (together, the "Vibes Parties"), exclude all liability, whether in contract, tort (including negligence), under statute or otherwise, for:
- any indirect, incidental, special, punitive or consequential loss or damage;
- any loss of profits, revenue, savings, data, goodwill, or anticipated savings; and
- any loss or damage arising from your use of, or inability to use, the Services or any product, from any third-party content or conduct, or from any matter outside our reasonable control,
even if the possibility of such loss was advised or foreseeable.
To the fullest extent permitted by law, and except in respect of the non-excludable rights described in the first paragraph of this section, the total aggregate liability of the Vibes Parties to you for any and all claims arising out of or in connection with the Services or any product is limited to the amount you paid to us for the product or order giving rise to the claim.
Where our liability for a failure to comply with a consumer guarantee that cannot be excluded under the Australian Consumer Law can be limited (and is not for goods or services of a kind ordinarily acquired for personal, domestic or household use, where such limitation is not permitted), our liability is limited, at our option, to replacing the goods, supplying equivalent goods, repairing the goods, or paying the cost of doing so.
Section 19 — Indemnification
To the fullest extent permitted by law, you agree to indemnify and hold harmless Vibes, Shopify and our affiliates, officers, directors, employees, agents, contractors, licensors and service providers from any claims, losses, liabilities, damages, costs and expenses, including reasonable legal fees, arising out of your User Content, your breach of these Terms, your violation of any law or third-party right, or your use of the Services or any product, including any use by another person accessing the Services through your account.
Section 20 — Termination
We may terminate this agreement or your access to the Services at any time at our discretion, with or without notice, and you will remain liable for all amounts due up to the date of termination. The sections that by their nature should survive termination, including Intellectual Property, Reviews and User Content, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability and Governing Law, will continue to apply.
Section 21 — Electronic Communications and Force Majeure
You consent to receive communications from us electronically, including notices, agreements and disclosures, and you agree that electronic communications satisfy any legal requirement that they be in writing. This does not affect your statutory rights.
We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including acts of God, natural disasters, fire, flood, pandemic, war, civil unrest, strikes, carrier or supplier failures, or shortages of materials, energy or transport.
Section 22 — Severability, Waiver and Entire Agreement
If any provision of these Terms is found to be unlawful, void or unenforceable, it will be enforceable to the fullest extent permitted by law, and the unenforceable portion will be severed without affecting the validity of the remaining provisions. Our failure to enforce any right or provision is not a waiver of that right. These Terms, together with any policies posted on our site, constitute the entire agreement between you and us regarding the Services, superseding any prior agreements. Any ambiguity will not be construed against the drafting party.
Section 23 — Assignment
You may not transfer or assign these Terms or your rights and obligations under them without our prior written consent, and any attempt to do so is void. We may transfer or assign these Terms and our rights and obligations without your consent or notice.
Section 24 — Governing Law
These Terms are governed by the laws of the State of Victoria, Australia, and the Commonwealth of Australia. You and Vibes submit to the non-exclusive jurisdiction of the courts of Victoria. If the law of your place of residence requires that consumer contracts be governed by local law, that requirement is not affected by this section to the extent it cannot lawfully be excluded.

You can review the most current version of these Terms at any time on this page. We may update or replace any part of these Terms by posting changes to our website, and it is your responsibility to check periodically. We will notify you of material changes in accordance with applicable law. Your continued use of the Services after changes are posted constitutes acceptance of them.
